Woman arrested as Berkeley battery, hate crime suspect - East Bay Times

BERKELEY — Police said they arrested a woman on suspicion of multiple charges after she allegedly struck and used hateful words against a passing pedestrian this week.

According to a police statement Wednesday, the pedestrian was walking just after 4 p.m. Tuesday in the 2500 block of Durant Avenue just east of Telegraph Avenue when she met a woman rummaging through a trash can who yelled at her. When she tried to walk around, the woman pushed her off the curb and she fell down on her back into the street.

“During the encounter, the suspect yelled several hateful statements about people of Mexican descent,” police said.

The victim. whose arms were full of shopping bags, was not able to break her fall but did not suffer serious injury. She told officers she did not know the suspect.

Officers responding to the incident found a 55-year-old woman a block west on Durant, and arrested her on suspicion of battery, as well as probation violation and an outstanding arrest warrant. She was also arrested on suspicion of a hate crime, which police described as a crime against “a person, group, or property motivated by the victim’s real or perceiving protected social group.”

“The Berkeley Police Department recognizes and places a high priority on the rights of all individuals guaranteed under state and federal law,” police said.

“The commission of a hate crime is a serious offense, which will not be tolerated in the City of Berkeley.”

The woman was cited and released from custody, according to a records check Thursday afternoon.
