Although designed to be an alternative to caging people in jail, electronic monitoring, or e-carceration, is now routinely and increasingly imposed as a condition of release for people who would otherwise just have been released and allowed to live their lives in freedom while fighting their case, reports Cathryn Crawford in an op-ed for Teen Vogue. She says this is due to a pervasive false narrative from city officials and law enforcement, printed by an unquestioning, complicit media that any so-called surge in crime is fueled by bail reform and by too many people being released pretrial.

From March 2020 to March 2021, the use of electronic monitoring in Chicago’s Cook County increased by 49 percent, with an average 3,652 people monitored daily. Of that, 93 percent are Black or brown and 95 percent are male. Meanwhile, the rate of rearrests for violent offenses while on release pending trial remains at 3 percent, the same as it was before Chicago limited the use of bail in 2017. Those sentenced to e-carceration face stifling restrictions on their daily lives that often makes them much more likely to plead guilty just to get released, even if they are innocent or have a viable defense. Fortunately, Illinois legislators recently passed the Pre-Trial Fairness Act (PFA). Among other necessary reforms, starting January 1, 2022, before ordering e-carceration, judges will first be required to share in writing why they believe e-carceration is necessary for the community’s safety. Every 60 days after, judges will be required to review their decision.
