In this episode of What’s Ahead, I urge Congress, as it puts together a police-procedure reform bill, to ban an abusive policy called civil asset forfeiture. The practice allows law enforcement to confiscate your cash, car, home and other personal property if law enforcement believes it was used in committing a crime or obtained from illicit activities. Shockingly—which is why this procedure must be prohibited—people’s possessions have been seized even when they were never charged with a crime, much less convicted. Civil asset forfeitures have become a source of government revenue, raising billions of dollars. It’s no surprise that the practice hurts those who have the least, especially minorities.
Congress should abolish this procedure and require actual criminal conviction before property can be seized.
