Hate crime filed in Berkeley store confrontation - East Bay Times

BERKELEY — A 63-year-old man suspected of racially abusing and threatening to kill a store owner has been charged with a hate crime and other counts, according to authorities and court records.

Calep Davis of Berkeley was charged Wednesday with violation of civil rights by threatening which is a hate crime,  obstructing or intimidating a business operator or customers and resisting arrest, all misdemeanors.   He is being held at Santa Rita jail and is scheduled to appear in court July 19 for arraignment.

Davis entered a convenience store in the 2000 block of San Pablo Avenue about 6:39 p.m. May 19 and opened up a bag of chips, authorities said.

When asked to leave by the store owner, he began to verbally racially abuse the owner, who is of Indian descent and speaks with an accent, according to court records.

According to the records, included in what Davis said to the owner was  “go back to your country. I’ll put you in a body bag and ship you back to your country.”

Police were called and confronted Davis in the area of San Pablo and University avenues where he refused to stop despite repeated commands, police said.  Officers watched him run back and forth into the street on University Avenue until he tripped over his own feet and was arrested.

According to jail records, no bail has been set for Davis, who listed his occupation as recycler.
